EV Driver Code of Conduct

1. Introduction

1.1 This EV Driver Code of Conduct (“Code”) sets out the standards of behaviour expected of all EV Drivers who book and use chargers through the Zingrev Platform (“Platform”), owned and operated by Zingrev OÜ (“Zingrev”, “we”, “our”, “us”).

1.2 This Code is part of the Terms of Service and is binding on all EV Drivers. Breaches of this Code may result in warnings, penalties, suspension, or permanent removal from the Platform.

1.3 The objectives of this Code are to:

      • Promote fairness, respect, and professionalism between EV Drivers and Charger Providers;
      • Ensure safe and lawful use of chargers;
      • Protect the integrity and reputation of the Zingrev Platform.


2. Legal and Regulatory Compliance

2.1 EV Drivers must comply with all applicable laws, regulations, and road safety rules when operating electric vehicles and using chargers.

2.2 Drivers must only use chargers in accordance with the manufacturer’s specifications and safety guidelines.

2.3 EV Drivers are prohibited from using chargers for unlawful activities (e.g., energy theft, unauthorized modifications, tampering with meters).

2.4 EV Drivers must comply with the data protection laws (GDPR) when processing or handling any personal data of Charger Providers.


3. Safety Standards

3.1 Proper Use of Equipment

      • EV Drivers must connect and disconnect their vehicles safely and in line with instructions.
      • Drivers must not damage, vandalize, or interfere with chargers or associated property.
      • Drivers may not use the charger location as a rendezvous point for their personal business or any other business use.
      • Drivers may not use the charger location or the devices for any criminal activity or for the planning of such activity.


3.2 Environmental Responsibility

      • Drivers must keep charging areas clean and free of litter.
      • Smoking, open flames, or hazardous behaviour at charging points is prohibited.


3.3 Emergency Situations

      • Drivers must follow safety instructions provided by Charger Providers or emergency personnel.
      • Any accidents, malfunctions, or hazards must be reported immediately to the Charger Provider and Zingrev Support, via the support channels provided.


4. Fairness and Transparency

4.1 Accurate Profile Information

  • EV Drivers must provide accurate and truthful information on the Platform, including their profile and contact details; vehicle details (make, model, connector type); Payment information.
  • Misrepresentation of vehicle compatibility or false identity is prohibited.

4.2 Respect for Reservation

  • EV Drivers must honor their reservations and avoid unnecessary no-shows or last-minute cancellations.
  • EV Drivers must honor their reservations by arriving on time and using the reserved charger responsibly.
  • EV Drivers must not make fraudulent, speculative, or duplicate reservations intended to block charger availability.
  • Cancellations must follow the Refunds & Cancellations Policy.

4.3 Use of Time Slots

      • EV Drivers must respect the time reserved and avoid overstaying beyond the booked session.
      • Unauthorized occupation of chargers beyond the reserved period may incur penalties


5. Professional Conduct with Charger Providers

5.1 Respectful Communication

      • EV Drivers must treat Charger Providers with courtesy and professionalism.
      • Harassment, verbal abuse, threatening or criminal behavior is strictly prohibited and may be penalized under the applicable laws.


5.2 Non-Discrimination

      • EV Drivers must not engage in discriminatory behavior towards Charger Providers based on race, religion, gender, nationality, disability, or any other protected characteristic.


5.3 Contact Boundaries

      • EV Drivers must only use in-app communication channels (chat or call) for matters directly related to Reservations.
      • Contacting Providers outside the Platform without consent is prohibited.


5.4 Lawful Use of Chargers

  • EV Drivers represent and warrant that they own or are lawfully entitled to operate the vehicle they charge.
  • EV Drivers represent and warrant that they will use chargers only for legitimate EV charging purposes and in accordance with manufacturer guidelines.
  • EV Drivers represent and warrant that they will not tamper with, damage, or misuse charging equipment.
  • EV Drivers represent and warrant that they will follow all instructions given by Charger Providers and any safety signage at charging locations.


5.5 Direct Contract with Charger Providers

  • EV Drivers acknowledge that Zingrev is not a party to such contract and acts only as an intermediary and facilitator;
  • EV Drivers acknowledge that any legal claims, disputes, or consumer complaints arising from the charging service itself are the responsibility of the Charger Provider.


6. Reliability and Accountability

6.1 Timeliness

  • EV Drivers must arrive at the charger on time for their Reservation.
  • Late arrivals may reduce available charging time and do not entitle the Driver to refunds beyond what is specified in the Refunds & Cancellations Policy.


6.2 No-Shows

If a Driver fails to attend a Reservation, the session is considered a no-show and is fully chargeable under the Refunds & Cancellations Policy.


6.3 Payment Obligations

  • EV Drivers acknowledge and agree that they must maintain valid and sufficient payment methods within the Platform;
  • EV Drivers acknowledge and agree that they authorise Zingrev and its Payment Provider to collect charges in accordance with the Payment Terms & Fees Policy;
  • EV Drivers acknowledge and agree that they are responsible for charges incurred through late cancellations, no-shows, or overstays as defined in the Refunds & Cancellations Policy;
  • EV Drivers acknowledge and agree that initiating unjustified chargebacks or payment disputes constitutes a breach of these Terms.


6.4 Assumption of Risk

  • EV Drivers acknowledge that the charging service is provided directly by the Charger Providers and not Zingrev;
  • EV Drivers acknowledge that Zingrev is not responsible for the quality, safety, or availability of electricity supplied by the Charger Providers;
  • EV Drivers acknowledge that they use chargers at their own risk and must exercise reasonable care.


7. Reviews, Ratings & Feedback

7.1 General Principles

Reviews and ratings are a cornerstone of trust on the Platform. They must be used honestly and responsibly.


7.2 Feedback on Charger Providers

  • EV Drivers may leave reviews for Charger Providers after completed sessions.
  • Feedback must reflect genuine experiences and must not include abusive, defamatory, or false statements.
  • Retaliatory or malicious reviews are prohibited.


7.3 Feedback on Zingrev

  • EV Drivers may share feedback about the Platform via official channels (in-app support, Helpdesk, surveys).
  • Public reviews (app stores, social media) must be fair, factual, and free from defamatory or misleading claims.
  • Coordinated campaigns to manipulate ratings or disparage Zingrev are prohibited.


7.4 Manipulation and Misuse

EV Drivers may not:

  • Offer or demand incentives for positive or negative reviews;
  • Post fake reviews;
  • Collude with other Users to manipulate ratings.


7.5 Consequences of Misuse

Zingrev may remove inappropriate reviews and impose penalties, including account suspension, followed by legal action in accordance with the law.

 

8. Data Protection and Privacy

8.1 EV Drivers must respect the privacy of Charger Providers and other Users.

8.2 Personal data obtained through the Platform (e.g., phone numbers, addresses) must not be used outside the context of the Reservation.

8.3 Any misuse of personal data may result in suspension and legal action.

 

9. Breaches of Code

9.1 Breaches of this Code may result in:

      • Warnings or advisory notices;
      • Restrictions on account usage;
      • Penalties, including monetary charges;
      • Temporary suspension or permanent removal from the Platform.
      • Legal action

 

9.2 Zingrev reserves the right to determine the appropriate sanction proportionate to the breach.

9.3 EV Drivers may appeal penalties by contacting Zingrev Support within 7 days of notification.

 

10. Governing Law

This Code is governed by the laws of Estonia and applicable EU law.

 

11. Indemnity

EV Drivers agree to indemnify, defend, and hold harmless Zingrev, its officers, employees, and affiliates against any claims, damages, fines, or expenses (including legal fees) arising from:

      • Misuse of charging equipment;
      • Breach of these Terms or applicable law;
      • Damage to property or injury to persons caused by their negligence or misconduct;
      • Fraudulent payments, chargebacks, or unlawful use of the Platform.
